Arizona Residential Lease Agreement Overview

Arizona's landlord-tenant law is governed by the Arizona Residential Landlord and Tenant Act (ARS § 33-1301 to 33-1381). Arizona is generally considered a landlord-friendly state with a quick eviction process, no rent control (in fact, Arizona law prohibits municipalities from enacting rent control), and moderate security deposit limits of 1.5 months' rent.

Eviction Process

Arizona requires a 5-day notice for nonpayment of rent. For material health and safety violations, a 5-day immediate notice to vacate may be given. For non-compliance with the lease, a 10-day notice with 5 days to cure is required. The eviction process is among the fastest in the country.

Habitability Standards

Arizona landlords must comply with building codes, maintain structural components, keep plumbing and electrical systems working, provide running water and reasonable heat and cooling, maintain supplied appliances, and provide working smoke detectors. Arizona also requires landlords to address bed bug infestations.

Arizona Security Deposit Rules

Arizona limits security deposits to 1.5 months' rent (ARS § 33-1321). Landlords must return the deposit within 14 business days of termination and delivery of possession. The landlord must provide an itemized statement of deductions. Arizona allows landlords to charge nonrefundable fees in addition to security deposits, but they must clearly state in writing which amounts are nonrefundable. If the landlord fails to comply, the tenant can recover up to twice the deposit amount.
