Illinois Sublease Agreement Overview
A sublease agreement in Illinois allows an existing tenant to re-rent some or all of their rental unit to another person for a period within the remaining lease term. Illinois has no statewide statute that automatically grants tenants the right to sublet. Outside Chicago, subletting rights are defined almost entirely by the lease contract, and most leases require written landlord consent before any sublease can proceed.
Chicago is a significant exception. The Chicago Residential Landlord and Tenant Ordinance (RLTO) applies to most residential rental units in the city and gives tenants a meaningful right to sublet. Under the RLTO, a landlord can require consent before the tenant sublets but cannot withhold that consent unreasonably. If a landlord refuses without a legitimate basis, the tenant may have remedies under the ordinance including the right to terminate the lease without penalty.
Regardless of whether a sublease is in Chicago or elsewhere in Illinois, the original tenant (sublessor) remains fully liable to the landlord for rent and all lease obligations throughout the sublease period. There is no privity between the sublessee and the landlord. A comprehensive sublease agreement documents each party's obligations clearly and protects the sublessor from bearing costs caused by a sublessee's failure.

Chicago RLTO vs. Statewide Rules
If your rental is in Chicago and is subject to the Residential Landlord and Tenant Ordinance, your landlord must have a reasonable basis to deny your sublease request. Outside Chicago, Illinois landlords have much broader discretion. Know which set of rules applies to your unit before relying on any subletting rights, and always get consent in writing before signing a sublease agreement.

How to Fill Out an Illinois Sublease Agreement
Follow these steps to complete your Illinois sublease agreement. The process is slightly different depending on whether you are in Chicago or elsewhere in the state.
Request and Secure Landlord Consent
Send your landlord a written sublease request that includes the proposed sublessee's name, contact information, employment status, and rental history. If you are in Chicago and subject to the RLTO, the landlord must respond within a reasonable time and cannot refuse without a legitimate reason. Outside Chicago, the landlord has broader discretion. Do not execute the sublease until you have written consent in hand.
Complete Party and Property Information
Fill in the full legal names and contact information for the sublessor, sublessee, and landlord. Reference the original lease by its execution date. Include the complete Illinois property address and unit number. Describe exactly which portion of the premises is being subleased if you are only subletting part of the unit.
Set Sublease Financial Terms
Specify the sublease start and end dates (the sublease cannot extend past the original Illinois lease expiration), the monthly rent amount, the payment due date, and acceptable payment methods. Set the security deposit amount. For Chicago properties subject to the RLTO, the deposit cannot exceed one and a half months' rent, must be held in a separate interest-bearing account, and must be returned with interest within 30 days after the sublessee vacates. Define which utilities each party pays.
Sign and Distribute
Both the sublessor and sublessee must sign and date the agreement. Provide fully executed copies to the sublessor, sublessee, and landlord. Attach the landlord's written consent letter, a copy of the original lease for the sublessee's reference, and a move-in condition checklist with dated photographs to document the unit's condition at the start of the sublease.
