In California, a sublease agreement transfers a tenant's right to occupy a rental unit to a new occupant for part of the original lease term. California provides particularly strong protections for tenants who want to sublet. Under California Civil Code § 1995.260, if a lease requires landlord consent to sublet, the landlord cannot unreasonably withhold that consent. California tenants have more legal leverage in this area than tenants in most other states.

Important: Rent Control and Subletting in California

If your unit is in a rent-controlled city such as San Francisco, Los Angeles, Oakland, or Berkeley, your local rent ordinance may prohibit charging the sublessee more than the rent you pay under the original lease. Exceeding rent-controlled rates in a sublease can expose you to penalties under local law. Check your city's rent stabilization ordinance before setting the sublease rent, and get the landlord's written consent before the sublessee moves in.

Sublessor (Original Tenant) Obligations

  • Request Landlord Consent in Writing: Submit a formal request with the proposed sublessee's information; under Cal. Civil Code § 1995.260 the landlord cannot unreasonably refuse
  • Remain Liable Under the Original Lease: Subletting does not release you from rent obligations; your landlord can still hold you responsible for defaults
  • Check Rent Control Status: Confirm whether the unit is subject to local rent stabilization before setting the sublease rate
  • Provide the Original Lease: Give the sublessee a full copy so they understand the property rules and any restrictions that apply
