Colorado Month-to-Month Lease Overview
Colorado month-to-month lease agreements are governed by Colorado Revised Statutes Title 38, Article 12. Recent legislative changes have significantly strengthened tenant protections in Colorado, including longer notice requirements for termination and new rules about rent increases.
Colorado\u2019s rental market has grown rapidly, particularly in the Denver, Boulder, and Colorado Springs metro areas. In 2023-2024, Colorado passed several tenant-protection laws, including allowing local rent stabilization and increasing notice periods. These changes make it important for both landlords and tenants to understand current requirements.

Colorado Month-to-Month Termination Notice Requirements
Colorado requires at least 21 days’ written notice to terminate a month-to-month tenancy for agreements of one to six months. For tenancies of six months or longer, 91 days’ notice is required. These requirements were updated by recent legislation (HB 1098).
Important: Written Notice Required
Colorado requires that termination notice be in writing. Verbal notice is generally not sufficient and may not be enforceable in court. Keep a copy of any notice you send or receive, and consider using certified mail or hand-delivery with a witness to prove delivery.
Colorado Rent Increase Notice Periods
Colorado landlords must provide at least 30 days’ written notice before increasing rent. While Colorado does not have statewide rent control, recent legislation allows local municipalities to enact rent stabilization measures.
How to Create a Colorado Month-to-Month Lease
Follow these steps to create a legally compliant month-to-month lease agreement for Colorado.
Identify the Parties and Property
Include the full legal names of the landlord and all tenants, the complete rental property address (including unit number), and the date the lease begins. Specify that this is a month-to-month tenancy that automatically renews.
Set the Rent and Payment Terms
State the monthly rent amount, the due date, acceptable payment methods, any grace period, and late fee terms. Under Colorado law, be sure to comply with any state requirements for grace periods and late fee limits.
Document the Security Deposit
Record the security deposit amount, how it will be held, conditions for deductions, and the return timeline. Colorado limits security deposits to No statutory limit and has specific requirements for how and when the deposit must be returned.
Include Notice Requirements
Clearly state the required notice period for termination (21 days in Colorado) and rent increases (30 days). Include how notice must be delivered (certified mail, hand delivery, etc.) and when the notice period begins.
Add House Rules and Sign
Include provisions for pets, guests, noise, parking, maintenance responsibilities, and any other rules. Both landlord and tenant should sign and date the agreement. Provide copies to all parties.
