Maine Sublease Agreement Overview

A Maine sublease agreement lets an existing tenant (the sublessor) rent their unit or a portion of it to a new occupant (the sublessee) for part of the remaining lease term. Maine landlord-tenant law is relatively tenant-protective. When a lease requires landlord consent before subletting, Maine law requires the landlord not to withhold that consent unreasonably. If the landlord refuses without a legitimate reason, the refusal may not be enforceable. Even so, the original tenant remains fully responsible to the landlord for rent and lease compliance throughout the sublease period.

Important: Maine Landlord Consent

Maine law requires that when a lease conditions subletting on landlord consent, the landlord cannot withhold that consent unreasonably. However, "unreasonably withheld" still allows a landlord to refuse a sublessee with poor credit, a history of evictions, or other legitimate concerns.
