Louisiana Sublease Agreement Overview

A Louisiana sublease agreement lets an existing tenant (the sublessor) rent their leased premises or a portion of them to a new occupant (the sublessee) for some portion of the remaining term. Louisiana is different from most U.S. states because it follows the civil law tradition rather than common law. Residential leases are governed by the Louisiana Civil Code, Articles 2668 through 2729, and Article 2713 specifically provides that a lessee may sublease unless the lease prohibits it. This is actually a more permissive default than in many other states.

Subletting is common in New Orleans, particularly in the French Quarter, Mid-City, and Uptown neighborhoods, where furnished short-term rentals are popular and the residential rental market sees high turnover. The Baton Rouge market near LSU also has active subletting activity around semester transitions. Louisiana's lessor's privilege, an automatic lien on the tenant's movable property inside the premises, applies in sublease relationships and can give the sublessor a useful remedy if the sublessee fails to pay rent.

Important: Louisiana Landlord Consent

Louisiana Civil Code Article 2713 permits subletting by default unless the lease prohibits it. However, most Louisiana residential leases include a written consent requirement. Even if the lease is silent, getting the landlord's written consent protects you from disputes. If the lease requires consent and you sublet without it, the landlord may have grounds to terminate the lease for breach of contract. Always secure written approval before allowing a sublessee to move in.
