Alaska Month-to-Month Lease Overview

Alaska’s month-to-month lease agreements are governed by the Alaska Uniform Residential Landlord and Tenant Act (AS 34.03). This comprehensive statute covers all aspects of the landlord-tenant relationship, including security deposits, maintenance obligations, and termination procedures for periodic tenancies.

Alaska’s unique geography and housing market make month-to-month leases particularly common, especially in areas with seasonal employment or military bases. The state allows security deposits of up to two months’ rent, and landlords must return deposits within 14 days for tenants who provide a forwarding address, or 30 days otherwise.

Alaska Month-to-Month Termination Notice Requirements

Alaska requires 30 days’ written notice to terminate a month-to-month tenancy under Alaska Statute 34.03.290. The notice must specify the date of termination and be delivered to the other party. Both landlords and tenants must comply with this notice requirement, and the termination date must fall on or after the last day of the next rental period.

Important: Written Notice Required

Alaska requires that termination notice be in writing. Verbal notice is generally not sufficient and may not be enforceable in court. Keep a copy of any notice you send or receive, and consider using certified mail or hand-delivery with a witness to prove delivery.

Alaska Rent Increase Notice Periods

Alaska landlords must provide at least 30 days’ written notice before increasing rent on a month-to-month lease. There is no rent control in Alaska, and landlords may adjust rent to market rates with proper notice.

How to Create a Alaska Month-to-Month Lease

Follow these steps to create a legally compliant month-to-month lease agreement for Alaska.

1

Identify the Parties and Property

Include the full legal names of the landlord and all tenants, the complete rental property address (including unit number), and the date the lease begins. Specify that this is a month-to-month tenancy that automatically renews.

2

Set the Rent and Payment Terms

State the monthly rent amount, the due date, acceptable payment methods, any grace period, and late fee terms. Under Alaska law, be sure to comply with any state requirements for grace periods and late fee limits.

3

Document the Security Deposit

Record the security deposit amount, how it will be held, conditions for deductions, and the return timeline. Alaska limits security deposits to 2 months and has specific requirements for how and when the deposit must be returned.

4

Include Notice Requirements

Clearly state the required notice period for termination (30 days in Alaska) and rent increases (30 days). Include how notice must be delivered (certified mail, hand delivery, etc.) and when the notice period begins.

5

Add House Rules and Sign

Include provisions for pets, guests, noise, parking, maintenance responsibilities, and any other rules. Both landlord and tenant should sign and date the agreement. Provide copies to all parties.
