South Dakota Vehicle Bill of Sale Overview

South Dakota takes a decentralized approach to vehicle titling and registration. Instead of a centralized DMV, the state relies on county treasurers to handle all title transfers, registrations, and license plate transactions. This means your local county treasurer's office is your go-to destination when buying or selling a vehicle in the state.

The South Dakota Department of Public Safety provides oversight for motor vehicle regulations, but the day-to-day processing happens at the county level. South Dakota charges a 4% excise tax on vehicle purchases — lower than the standard sales tax rate — along with potential local taxes of up to 3.5% in some municipalities.

The state does not require emissions testing, safety inspections, or notarization for private party vehicle sales. Registration fees are calculated based on the vehicle's age and weight rather than its value, which can be advantageous for owners of newer, high-value vehicles. A clear, complete bill of sale protects both parties and helps the county treasurer calculate the correct excise tax.

South Dakota DPS Requirements

South Dakota's county-based system means requirements are consistent statewide but processed locally. Here's what you need for a private party vehicle transfer:

Important: County Treasurers Handle Everything

Unlike most states with centralized DMV offices, South Dakota processes all title transfers and registrations through county treasurers. Visit the county treasurer's office in the county where the buyer resides. Hours and availability vary by county, and some rural counties may have limited office hours, so call ahead to confirm.

What the Seller Must Provide

  • Signed Vehicle Title: Complete the assignment section with the buyer's name, date of sale, sale price, and odometer reading
  • Bill of Sale: A completed bill of sale with buyer/seller information, vehicle details, VIN, sale price, date, and signatures
  • Odometer Disclosure: Federal requirement — mileage and accuracy statement on the title or a separate disclosure form
  • Lien Release: If the vehicle had a loan, written proof that the lien has been satisfied

What the Buyer Must Bring to the County Treasurer

  • Signed Title: With seller's signature and all assignment fields completed
  • Bill of Sale: Signed by both buyer and seller
  • Valid Photo ID: South Dakota driver's license or state ID
  • Proof of Insurance: South Dakota minimum liability coverage ($25,000/$50,000/$25,000)
  • Payment: Title fee ($10), registration (based on age + weight), and 4% excise tax + local

How to Fill Out a South Dakota Vehicle Bill of Sale

Follow these six steps to properly complete your South Dakota vehicle bill of sale. Our template covers all the information your county treasurer needs to process the transfer.

1

Enter Seller Information

Provide the seller's full legal name as it appears on the South Dakota title, current mailing address, and phone number. If multiple owners are listed on the title, check whether they are joined by "and" (all must sign) or "or" (either can sign).

2

Enter Buyer Information

Fill in the buyer's full legal name exactly as it should appear on the new title, current South Dakota address, and contact details. The buyer's county of residence determines which county treasurer's office will handle the transfer and what local tax rate may apply.

3

Describe the Vehicle

Enter the year, make, model, body type, and exterior color. Record the complete 17-character VIN from the dashboard or door jamb and verify it matches the title. Since registration fees in South Dakota depend on vehicle age and weight, accurate vehicle details are essential.

4

Record the Odometer Reading

Write down the current odometer mileage and note whether the reading is accurate, has exceeded mechanical limits, or is not the actual mileage. This is a federal requirement under NHTSA regulations. Vehicles 20 model years old or older and those with a GVWR over 16,000 lbs may be exempt.

5

State the Sale Price

Enter the agreed purchase price in both numerals and words. The county treasurer uses this amount to calculate the 4% excise tax plus any applicable local taxes. If the vehicle is a gift, write "$0 — Gift" and indicate the relationship. The county may use fair market value for excise tax purposes on gifts between unrelated parties.

6

Sign and Date

Both the buyer and seller must sign and date the bill of sale. Make at least two copies — one for each party. South Dakota does not require notarization, so the signed document is ready to present at the county treasurer's office. Complete the transfer within 30 days of the sale date.

South Dakota Title Transfer Process

Once the sale is complete, the buyer must visit the county treasurer's office in their county of residence to finalize the transfer. South Dakota's county-based system is straightforward and typically involves shorter wait times than centralized DMV offices.
