Oregon Lease Termination Overview

Oregon has one of the most tenant-protective landlord-tenant frameworks in the country, shaped by landmark legislation SB 608 (2019). Lease termination is governed by ORS Chapter 90, which establishes just-cause eviction requirements after the first year of occupancy, statewide rent control (7% + CPI annual cap), and mandatory relocation assistance for qualifying no-cause terminations.

During the first year of a tenancy, a landlord may terminate a month-to-month tenancy with 30 days written notice without cause. After the first year, the landlord must have a qualifying reason under ORS 90.427, divided into "for-cause" reasons (non-payment, lease violation, criminal activity) and "qualifying landlord reasons" (owner move-in, sale, renovation, demolition). For qualifying landlord reasons, the landlord must provide 90 days notice and pay one month's rent as relocation assistance.

Oregon's rent control (ORS 90.323) caps annual increases at 7% plus the local consumer price index. Properties less than 15 years old are exempt. The security deposit must be returned within 31 days (ORS 90.300). Portland has additional local protections including higher relocation assistance requirements and the FAIR ordinance.

Oregon SB 608 Just-Cause Eviction

After the first year of occupancy, Oregon landlords cannot terminate without cause. Qualifying landlord reasons (owner move-in, sale, renovation, demolition) require 90 days notice plus one month's rent relocation assistance. If the landlord fails to pay relocation assistance within 15 days of serving the notice, the termination notice is void. Portland requires even higher relocation payments under its local ordinance.

Security Deposit After Lease Termination in Oregon

ORS 90.300 governs security deposits. The landlord must return the deposit or provide an itemized accounting within 31 days after the tenant vacates. Permissible deductions include unpaid rent and damages beyond normal wear and tear. If the landlord fails to comply, the tenant may recover up to twice the amount wrongfully withheld. Oregon does not impose a statutory cap on security deposits, but they must be "reasonable."

The landlord must provide the tenant with a written statement of the condition of the premises at the beginning of the tenancy if collecting a security deposit. At move-out, the landlord must send the itemized statement and any refund to the tenant's forwarding address. Oregon also requires landlords to refund any prepaid rent on a prorated basis.
