Montana Lease Termination Overview

Montana adopted its version of the Uniform Residential Landlord and Tenant Act (URLTA), codified at Mont. Code Ann. Title 70, Chapters 24 and 25. This gives Montana one of the more comprehensive landlord-tenant statutes in the Mountain West region. The Act establishes clear rules for notice periods, habitability standards, security deposit handling, and the termination process for both periodic and fixed-term tenancies.

For month-to-month tenancies, either party must provide at least 30 days written notice before the next rent due date (MCA 70-24-441). Montana does not have rent control or a just-cause eviction requirement, meaning a landlord can decline to renew a periodic tenancy for any non-retaliatory, non-discriminatory reason. However, Montana's anti-retaliation statute (MCA 70-24-431) provides meaningful protection for tenants who exercise their legal rights.

Montana's habitability protections are particularly notable. Under MCA 70-24-303 and 70-24-406, landlords must maintain the dwelling in a fit and habitable condition, and tenants may terminate if essential services (heat, water, hot water, electricity) are interrupted for extended periods. The security deposit is limited and must be returned within 30 days (or 10 days in non-compliance terminations) under MCA 70-25-202.

Montana Habitability Termination

Montana provides strong habitability protections. Under MCA 70-24-406, if a landlord fails to maintain the unit in compliance with MCA 70-24-303 (health and safety standards) and does not remedy the condition within 14 days of written notice, the tenant may terminate the lease. For essential service interruptions (heat, water, electricity), tenants have additional remedies under MCA 70-24-408 including obtaining substitute housing at the landlord's expense.

Handle Security Deposit and Move-Out

Document the property condition with photos. The landlord has 30 days to return the deposit or provide an itemized statement of deductions under MCA 70-25-202. Montana limits deposits and requires specific itemization of any amounts withheld.

Security Deposit After Lease Termination in Montana

Montana Code Ann. 70-25-202 sets the rules for security deposit return. The landlord must mail the deposit refund or itemized statement of deductions to the tenant's last known address within 30 days after termination and delivery of possession. If the tenancy ended due to the tenant's non-compliance, the return period is shortened to just 10 days.

Permissible deductions include unpaid rent, damages beyond normal wear and tear, and the costs of cleaning to restore the premises to the condition at move-in. Montana limits the security deposit based on the lease duration: for tenancies of 6 months or less, the maximum deposit is one month's rent. The landlord must hold the deposit in a separate account and cannot commingle it with personal funds. Wrongful retention of the deposit may result in the tenant recovering the amount withheld plus damages.
