Missouri Lease Termination Overview

Lease termination in Missouri is governed by Mo. Rev. Stat. Chapter 441 (Landlord-Tenant) and Chapter 535 (actions to recover possession). Missouri follows a relatively landlord-friendly framework with no statewide rent control, no just-cause eviction requirement, and a straightforward 30-day notice period for month-to-month tenancies. The state's security deposit statute (Mo. Rev. Stat. 535.300) imposes a two-month cap on deposits and a 30-day return deadline.

Missouri added domestic violence protections in 2017 with Mo. Rev. Stat. 441.920, allowing victims of domestic violence, sexual assault, or stalking to terminate leases early with 30 days notice and documentation. Kansas City and St. Louis have local tenant protection ordinances that supplement state law, though neither city has enacted just-cause eviction.

For fixed-term leases, the tenancy ends on the specified date without the need for a termination notice unless the lease requires one. If a tenant holds over after a fixed term and the landlord accepts rent, a month-to-month tenancy is created under Missouri common law. Missouri courts handle evictions through associate circuit court or small claims, and the process is relatively fast after proper notice has been given.

Missouri Rent Demand Notice

Missouri does not require a statutory "pay or quit" notice period before filing for eviction based on non-payment of rent. However, many leases include a grace period, and courts generally expect landlords to demand payment before filing suit. Kansas City and St. Louis have local notice requirements, so always check local ordinances in addition to state law.

How to Terminate a Lease in Missouri

Follow these steps to properly terminate a lease in Missouri and protect your legal rights.

1

Review Your Lease Terms

Determine whether the lease is month-to-month or fixed-term. Check for any automatic renewal clauses, required notice periods longer than the statutory minimum, and specified delivery methods for notices.

2

Prepare Written Notice

Draft a clear written notice stating your intent to terminate, the property address, the effective termination date (at the end of a rental period), and your forwarding address for security deposit return purposes.

3

Serve the Notice Properly

Deliver the notice by personal service with a signed receipt, certified mail with return receipt requested, or as specified in the lease. Keep copies of all notices and delivery receipts for your records.

4

Complete Move-Out and Deposit Return

Document the unit's condition with photos at move-out. Return all keys. The landlord has 30 days to return the deposit or provide an itemized deduction statement under Mo. Rev. Stat. 535.300. The deposit cap is two months' rent.

Security Deposit After Lease Termination in Missouri

Missouri Rev. Stat. 535.300 governs security deposits. Landlords may collect up to two months' rent as a security deposit. After the tenant vacates and provides a forwarding address, the landlord has 30 days to return the deposit or provide an itemized statement of deductions. The 30-day clock does not start until the tenant provides a forwarding address in writing.

Permissible deductions include unpaid rent, damages beyond normal wear and tear, and breach of the lease agreement. If the landlord wrongfully withholds any portion of the deposit, the tenant may recover up to twice the amount wrongfully withheld plus reasonable attorney fees. Missouri courts take the itemization requirement seriously, and a landlord who fails to provide a proper statement within 30 days may forfeit the right to withhold any portion of the deposit.
