Idaho's 3-Day Notice

Idaho's 3-day notice to pay or quit is among the shortest in the country. The 3-day period begins the day after the notice is served and excludes weekends and court holidays. If the tenant fails to pay or vacate within 3 days, the landlord may file an unlawful detainer action in Idaho Magistrate Court. Review Your Lease Agreement

Security Deposit After Lease Termination in Idaho

Idaho's security deposit rules are found in Idaho Code section 6-321. Unlike most states, Idaho does not impose a statutory cap on the amount a landlord may collect as a security deposit. After the tenant vacates and provides a forwarding address, the landlord has 21 days to return the deposit or provide an itemized statement of deductions. However, the lease agreement may extend this period up to 30 days.

Permissible deductions include unpaid rent, late fees authorized by the lease, damages beyond normal wear and tear, and cleaning costs if the unit is not returned in the same condition as at move-in (normal wear and tear excepted). If the landlord fails to return the deposit or provide the required itemized statement within the statutory period, the tenant may sue for up to three times the amount wrongfully withheld. Idaho does not require landlords to pay interest on deposits or maintain them in a separate account.
