Security Deposit After Lease Termination in Delaware

Under 25 Del. C. 5514, the landlord must return the security deposit within 20 days after the tenant vacates. Permissible deductions include unpaid rent and damages beyond normal wear and tear.

If the landlord fails to return the deposit or provide an itemized statement within 20 days, the tenant may recover double the amount wrongfully withheld. Delaware does not require interest on security deposits. The landlord must hold the deposit in a federally insured financial institution in the state of Delaware and provide the tenant with the location of the deposit.
