What Is a Maintenance Request Form?

A maintenance request form is a formal written document that tenants use to notify their landlord or property manager of necessary repairs, maintenance issues, or safety hazards in their rental unit. It serves as the official channel for reporting problems ranging from minor inconveniences like a dripping faucet to urgent emergencies like a gas leak or burst pipe. The form creates a timestamped record of when the landlord was notified, which is critical for establishing the landlord's legal obligation to respond and make repairs.

Under the implied warranty of habitability — a legal doctrine recognized in virtually every state — landlords are required to maintain rental properties in a condition fit for human habitation. This includes providing working plumbing, heating, electricity, structural integrity, weatherproofing, and sanitation throughout the tenancy. When tenants submit a maintenance request, they are formally notifying the landlord of a condition that may violate this warranty, triggering the landlord's legal duty to respond within a reasonable timeframe.

Maintenance requests are classified as either emergency or non-emergency. Emergency requests involve conditions that pose an immediate threat to health, safety, or property — such as gas leaks, flooding, no heat in winter, electrical hazards, or broken exterior security. Non-emergency requests cover issues that, while needing attention, do not create immediate danger — such as a running toilet, a broken dishwasher, or peeling paint. The classification affects the landlord's required response time.

If a landlord fails to address a legitimate maintenance request within a reasonable time, tenants may have legal remedies available depending on their state, including rent withholding, the repair-and-deduct remedy, filing a complaint with local housing authorities, or in severe cases, lease termination based on constructive eviction. These remedies underscore the importance of submitting maintenance requests in writing and maintaining thorough documentation.

How to Write a Maintenance Request

Follow these steps to submit an effective maintenance request that protects your rights and gets repairs completed promptly.

1

Determine the Priority Level

Classify the issue as emergency (immediate health/safety threat requiring 24-hour response), urgent (significant habitability issue requiring response within 48-72 hours), or routine (non-critical maintenance requiring response within 14-30 days). Emergency issues should be reported immediately by phone in addition to submitting a written request. If there is a gas leak, call 911 and your gas company before contacting the landlord.

2

Document the Problem

Before submitting the request, take photographs and/or video of the issue. If there is water damage, document the extent of the damage. If an appliance is malfunctioning, describe the specific symptoms. Note when the problem first appeared and whether it has gotten worse over time. This documentation supports your request and provides evidence if the landlord disputes the severity of the issue.

3

Write a Clear Description

Describe the problem in specific, objective terms. Instead of "the sink is broken," write "the kitchen sink faucet drips continuously at approximately 1 drip per second, wasting water and creating a stain on the porcelain basin." Include the exact location (room, wall, fixture), the nature of the problem, when it occurs, and any temporary measures you have taken to mitigate damage.

4

Reference Your Lease and Legal Rights

If the repair involves a habitability issue, reference the implied warranty of habitability and your landlord's obligation to maintain the property. Cite specific lease provisions related to maintenance responsibilities. This communicates that you understand your rights and expect the landlord to fulfill their legal obligations. Keep the tone professional and factual rather than threatening.

5

Provide Access Information

Indicate whether you give permission for the landlord or maintenance staff to enter your unit (with proper notice as required by state law), your preferred times for access, whether there are pets that need to be secured, and any special access instructions. This helps the landlord schedule the repair efficiently and ensures compliance with your state's notice-of-entry requirements.

6

Submit and Confirm Receipt

Submit the request via the method specified in your lease (online portal, email, or written form). If using email, request a delivery/read receipt. If submitting a paper form, get a signed copy acknowledging receipt. Keep copies of everything including the original request, any photographs, the landlord's acknowledgment, and all follow-up communications. This paper trail is essential if you need to pursue legal remedies later.
