Idaho Code Title 6, Chapter 3 governs unlawful detainer proceedings. The 3-day notice applies to non-payment (I.C. 6-303(2)), assignee or subtenant holdovers (I.C. 6-303(3)), waste or nuisance (I.C. 6-303(4)), and using the property for unlawful purposes (I.C. 6-303(5)). Idaho requires a 3 days notice under I.C. 6-303. Using the wrong notice period is one of the most common grounds for dismissal in Magistrate Court.

3 Days Notice (I.C. 6-303)

The landlord must deliver a written notice giving the tenant the required time to pay rent or vacate. The notice must state the exact amount of past-due rent. If the tenant pays in full within the notice period, the notice is void and the tenancy continues.
