New York Firearm Bill of Sale Overview

New York has some of the strictest firearm laws in the nation. All firearm transfers must go through a licensed dealer with a NICS background check. Handgun possession requires a license issued by a county judge or NYC police commissioner. New York enacted the Concealed Carry Improvement Act (CCIA) in 2022 in response to the Bruen decision.

To possess a handgun in New York, you must obtain a handgun license from the county where you reside (or the NYPD in NYC). This process involves extensive background checks, character references, and can take 6-18 months. All handguns are registered on the license. Long gun purchases require a background check through an FFL but no license.

New York has a comprehensive assault weapons ban (the SAFE Act, 2013), a 10-round magazine limit (7-round for loading), and bans on binary triggers and certain other accessories. NYC has additional restrictions beyond state law, including requiring a permit for long guns. The CCIA created extensive 'sensitive locations' where carry is prohibited.

Important: Background Check Required

New York requires background checks for private firearm sales. All transfers must be conducted through a licensed dealer. Failure to comply with this requirement may result in criminal penalties. Even with a background check, it is illegal to sell to a known prohibited person.

Include Eligibility Statement

The buyer should sign a statement affirming they are legally eligible to purchase and possess firearms under both federal and New York law, that they are not a prohibited person, and that they are a resident of New York.

Sign, Date, and Keep Copies

Both parties must sign and date the bill of sale. Print at least two copies — one for each party. Keep your copy indefinitely as there is no statute of limitations on ATF firearm traces. Remember that the transfer must also be processed through an FFL with a background check.
