Maryland Firearm Bill of Sale Overview

Maryland has strict firearm transfer laws. All transfers of 'regulated firearms' (handguns and certain semi-automatic rifles) must go through the Maryland State Police (MSP) or an FFL with a 7-day waiting period. All regulated firearms are registered with MSP.

Maryland's Handgun Qualification License (HQL) requirement has been subject to legal challenges following the Bruen decision and was largely invalidated. All regulated firearm purchases require a background check processed by MSP. Long gun private sales do not require a background check under state law.

Maryland has an assault weapons ban (2013), a 10-round magazine limit, and prohibits certain features on semi-automatic rifles. The state issues Wear and Carry Permits through MSP on a shall-issue basis following the Bruen ruling. Maryland also has a red flag law.

Maryland requires background checks for private firearm sales. All transfers must be conducted through a licensed dealer. Failure to comply with this requirement may result in criminal penalties. Even with a background check, it is illegal to sell to a known prohibited person.

Include Eligibility Statement

The buyer should sign a statement affirming they are legally eligible to purchase and possess firearms under both federal and Maryland law, that they are not a prohibited person, and that they are a resident of Maryland.

Sign, Date, and Keep Copies

Both parties must sign and date the bill of sale. Print at least two copies — one for each party. Keep your copy indefinitely as there is no statute of limitations on ATF firearm traces. Remember that the transfer must also be processed through an FFL with a background check.
