Alabama Firearm Bill of Sale Overview

Alabama is one of the most permissive states for private firearm sales. There is no state requirement for background checks on private sales between Alabama residents. The state does not require firearm registration, and there is no waiting period for any firearm purchase. Alabama adopted permitless carry (also called Constitutional carry) in 2023, meaning residents 21 and older can carry a concealed handgun without a permit.

Private firearm transfers in Alabama are governed primarily by federal law. As long as both parties are Alabama residents and the buyer is not a prohibited person under federal law, the sale can proceed without involving a licensed dealer. However, creating a bill of sale is strongly recommended as the only record of the transaction. Alabama law does not restrict the types of firearms that can be sold in private sales beyond federal restrictions.

Alabama has a strong tradition of gun ownership and hunting, and the state has enacted preemption laws that prevent local municipalities from passing firearm regulations stricter than state law. The Alabama Law Enforcement Agency (ALEA) oversees concealed carry permits for those who choose to obtain one, though a permit is no longer required for concealed carry.

Alabama Firearm Transfer Requirements

Alabama's firearm transfer laws are among the least restrictive in the nation. Here's what you need to know for private sales:

Important: Federal Law Still Applies

Even though Alabama does not require background checks for private sales, federal law still prohibits selling a firearm to anyone you know or reasonably believe is a prohibited person. This includes convicted felons, domestic violence offenders, and unlawful drug users. Violations carry up to 10 years in federal prison.

Seller Requirements

  • Verify Residency: Confirm the buyer is an Alabama resident — private interstate sales are illegal under federal law
  • Age Requirement: The buyer must be at least 18 for long guns (rifles/shotguns) and 21 for handguns in private sales under federal guidelines
  • Bill of Sale: Complete a bill of sale documenting the firearm, both parties, and the sale details — this is your only record of the transfer
  • No Prohibited Buyers: Do not sell to anyone you know or suspect is prohibited from possessing firearms under federal or state law

Buyer Requirements

  • Alabama Residency: Must be a current resident of Alabama with valid Alabama ID
  • Age: At least 18 for rifles and shotguns, 21 for handguns
  • Not Prohibited: Must not be a prohibited person under federal or Alabama law
  • Bill of Sale: Sign the bill of sale and retain your copy as proof of legal purchase

How to Fill Out a Alabama Firearm Bill of Sale

Follow these steps to properly complete your Alabama firearm bill of sale. Our template guides you through each field to ensure compliance with Alabama and federal requirements.

1

Enter Seller Information

Include the seller's full legal name, current Alabama mailing address, date of birth, and government-issued ID number (driver's license or state ID). This information is critical for establishing a clear chain of custody for the firearm.

2

Enter Buyer Information

Include the buyer's full legal name, current Alabama address, date of birth, and ID number. Verify the buyer's ID is valid and current. Confirm the buyer is a Alabama resident — selling to an out-of-state resident in a private sale is a federal crime.

3

Describe the Firearm

Record the firearm's make (manufacturer), model, serial number, caliber or gauge, type (handgun, rifle, shotgun), barrel length, and finish/color. The serial number is the most important identifier — verify it matches the physical firearm exactly.

4

State the Sale Price

Enter the agreed purchase price in both numbers and words. Note the payment method. If the firearm is a gift, write "$0 — Gift." If a trade, describe the items exchanged.

5

Include Eligibility Statement

The buyer should sign a statement affirming they are legally eligible to purchase and possess firearms under both federal and Alabama law, that they are not a prohibited person, and that they are a resident of Alabama.

6

Sign, Date, and Keep Copies

Both parties must sign and date the bill of sale. Print at least two copies — one for each party. Keep your copy indefinitely as there is no statute of limitations on ATF firearm traces.

Alabama Firearm Transfer Process

While Alabama does not require background checks for private sales, following a structured process protects both parties:

1

Verify Both Parties' Eligibility

Check IDs to confirm both parties are Alabama residents and of legal age. The seller should have no reason to believe the buyer is a prohibited person.

2

Meet in a Safe Location

Conduct the transaction in a public place, such as a police station parking lot or gun range. Many Alabama police departments offer safe transaction zones.

3

Complete and Sign the Bill of Sale

Fill in all fields including the serial number, both parties' information, and the sale price. Both parties sign and date.

4

Exchange Payment and Firearm

Complete the payment and transfer the firearm. Each party keeps their signed copy of the bill of sale.

5

Store Your Records Securely

Keep your copy of the bill of sale in a safe place indefinitely. This is your proof of legal transfer if the firearm is ever traced.
