Iowa uses a 3-day notice for non-payment of rent and a 7-day notice for material lease violations. There is no statutory 10-day notice period in Iowa law. Iowa's 2017 legislative changes significantly limited local tenant protections by enacting a preemption statute (Iowa Code §364.3(12)) that prevents cities from creating eviction notice requirements beyond state law. This means all 99 Iowa counties follow the same state-level notice periods. Polk County (Des Moines) and Linn County (Cedar Rapids) handle the highest volumes of FED filings.

Iowa Code Chapter 562A Requirements

Iowa's URLTA sets specific requirements for eviction notices.

  • Written Notice: Must be in writing. Iowa does not recognize verbal eviction notices
  • Specific Amount/Violation: For non-payment, state the exact rent due. For violations, describe the specific breach
  • Cure Opportunity: 3 days to pay for non-payment; 7 days to cure for first-time violations
  • Service Method: Personal delivery, leaving at dwelling, or mailing per §562A.29
  • Repeat Violation Warning: For lease violations, note that a repeat within 6 months may result in unconditional termination
  • Property Address: Complete address of the rental unit

Iowa District Court FED Process

Iowa's FED process is designed for expedited resolution. After filing, the court schedules a hearing within 8 to 15 days. The tenant receives notice of the hearing. At the hearing, both parties present evidence. Iowa District Courts handle FED cases with dedicated dockets in high-volume counties like Polk and Linn.

If the landlord prevails, the court enters judgment and issues a Writ of Removal. The sheriff serves the writ and enforces it within 3 to 7 days. Iowa does not have a mandatory stay of execution period for FED judgments.

Total uncontested timeline: 2 to 4 weeks. Contested: 4 to 6 weeks. Appeals are to the Iowa District Court (if filed in small claims) or the Iowa Court of Appeals, and require the tenant to post a bond.
