What Is an AI Workplace Policy?

An AI workplace policy is the written rule defining how employees, contractors, and agents may use artificial intelligence tools in the course of work. It addresses risks that traditional IT acceptable-use policies do not contemplate: hallucinated citations and fabricated facts, inadvertent disclosure of trade secrets and client data through prompts, copyright eligibility under U.S. Copyright Office Statement of Policy 88 Fed. Reg. 16190 (March 16, 2023), algorithmic bias under Title VII (42 U.S.C. § 2000e) and the ADA (42 U.S.C. § 12112), and the expanding state AI-employment statute matrix.

The risk profile is concrete. Mata v. Avianca, Inc., 678 F. Supp. 3d 443 (S.D.N.Y. 2023), sanctioned counsel for filing six fabricated ChatGPT-generated cases. Thaler v. Perlmutter, 687 F. Supp. 3d 140 (D.D.C. 2023), confirmed AI-generated content without human authorship is uncopyrightable. The first EEOC AI settlement (iTutorGroup, $365,000, August 2023) targeted age-discriminatory algorithmic screening. State enforcement: NYC Local Law 144 (effective July 5, 2023) requires annual independent bias audits of Automated Employment Decision Tools, public posting of summary results, and 10-business-day candidate notice. Illinois AI Video Interview Act (820 ILCS 42/) requires applicant notice and consent. Maryland Lab. & Empl. Code § 3-717 prohibits facial recognition without consent. Federal frameworks govern policy structure. The NIST AI Risk Management Framework (AI RMF 1.0, January 2023) is the recognized standard for organizational AI governance: GOVERN, MAP, MEASURE, MANAGE functions with associated controls. Executive Order 14110 (October 30, 2023) directed federal agencies to develop AI safety guidelines that now inform private-sector best practices. The EEOC's May 18, 2023, Technical Assistance Document on Software, Algorithms, and AI confirms employers bear Title VII disparate-impact liability under Griggs v. Duke Power Co., 401 U.S. 424 (1971), even when AI tools are vendor-developed. A written policy keyed to NIST AI RMF and EEOC guidance is the predicate for defending any AI-related charge or suit.

NIST AI Risk Management Framework and EEOC enforcement

The NIST AI RMF 1.0 (January 2023) and accompanying NIST AI 600-1 Generative AI Profile (July 2024) provide the federal-recognized framework for AI governance. The four functions (GOVERN, MAP, MEASURE, MANAGE) translate into policy provisions: governance roles and accountability; mapping of AI use cases to risk tiers; measurement of bias, accuracy, and security through documented testing; and management of incidents through reporting and remediation. The EEOC's May 18, 2023, Technical Assistance Document on Software, Algorithms, and AI applies the four-fifths rule from the Uniform Guidelines on Employee Selection Procedures (29 C.F.R. § 1607.4(D)) to AI screening tools: selection rates for any protected class less than four-fifths of the highest-rate group are evidence of disparate impact. State AI laws: NYC Local Law 144, IL, MD, CO

New York City Local Law 144 (effective July 5, 2023) requires employers using Automated Employment Decision Tools (AEDTs) to conduct annual independent bias audits, publish summary results, and provide candidates 10 business days' written notice that an AEDT will be used. Illinois AI Video Interview Act (820 ILCS 42/, effective January 2020, amended January 2022) requires written notice and consent before AI video analysis and limits sharing of candidate videos. Maryland Lab. & Empl. Code § 3-717 (effective October 2020) prohibits facial recognition in interviews without written consent. Colorado SB 24-205, the Colorado AI Act (effective February 2026), requires deployers of high-risk AI systems including employment tools to conduct impact assessments, notify consumers, and report discrimination to the Attorney General. California AB 2602 (introduced 2024) addresses generative AI replicas. The policy must be drafted to satisfy the most protective rule in each state and city of operation.

How to Draft an AI Workplace Policy

Audit current AI use and map to NIST AI RMF risk tiers

Survey every department to identify which AI tools are already in use, what data is being entered, and what outputs are relied upon. Common findings: marketing using consumer ChatGPT for content drafts (Tier 2 risk), engineering using GitHub Copilot for code (license-compliance risk), HR using algorithmic resume screeners (NYC Local Law 144 and Title VII risk), finance using AI for data analysis (verification risk). Map each use case to NIST AI RMF risk tiers per AI 600-1 Generative AI Profile (July 2024). The audit produces the risk surface; a policy drafted without it ships disconnected from practice and creates additional exposure when discovery surfaces undocumented use.

Classify data and define prohibited inputs by tier

Build the tier system with legal, IT security, and compliance. Tier 1 (never enter): trade secrets (Defend Trade Secrets Act, 18 U.S.C. § 1836), PII subject to HIPAA (45 C.F.R. § 160.103), GLBA (15 U.S.C. § 6809), FERPA (20 U.S.C. § 1232g), or COPPA (15 U.S.C. § 6501); SSN and financial account numbers; attorney-client privileged communications; material nonpublic information triggering Securities Exchange Act § 10(b); M&A data; client information subject to NDA. Tier 2 (enterprise AI with executed DPA and zero-retention configuration): internal documents, non-sensitive business data, anonymized metrics. Tier 3 (any approved tool): public information, formatting assistance, general knowledge queries. State that mosaic disclosure across multiple prompts is treated as Tier 1 disclosure.

Establish verification and AI-assistance disclosure protocols

Mandate human verification of all AI-generated content before external use, client delivery, regulatory filing, or operational reliance. Tier the protocol by department: legal must verify every case citation, statute reference, and regulatory interpretation against Westlaw, Lexis, or primary sources (Mata v. Avianca, Inc., 678 F. Supp. 3d 443 (S.D.N.Y. 2023), is the controlling cautionary authority); finance must verify all calculations and projections; marketing must fact-check all claims; engineering must review for security vulnerabilities and license compliance. Define disclosure obligations: to clients per engagement letters and ethics rules (ABA Formal Opinion 512, July 2024), in regulatory filings where required, in published content per platform terms, and in internal work-product tracking.

Address AI in hiring with bias-audit and accommodation provisions

If AI is used in recruiting, screening, interviewing, evaluation, or promotion, the policy must address EEOC Title VII liability under the May 18, 2023, Technical Assistance Document, ADA accommodation duties under the May 12, 2022, ADA guidance, and state requirements: NYC Local Law 144 (annual independent bias audit, public summary, 10-day candidate notice), Illinois AI Video Interview Act (820 ILCS 42/, applicant consent), Maryland Lab. & Empl. Code § 3-717 (facial-recognition consent), Colorado AI Act (impact assessment by February 2026 for high-risk systems). Require human decision-makers with authority to override AI recommendations. Document the business necessity for AI use under the Uniform Guidelines (29 C.F.R. § 1607.4(D)) four-fifths rule and run quarterly bias testing.

Build the training curriculum and tiered discipline framework

Train at onboarding and annually. Cover AI mechanics, the data classification tiers with examples, live hallucination demonstrations, the approved-tool list, the incident-reporting channel, and department-specific verification protocols. Define the discipline tiers: inadvertent misuse (verbal counseling, retraining), negligent data exposure (written warning, retraining, IT lockdown, breach-notification analysis under CA Civ. Code § 1798.82, NY Gen. Bus. Law § 899-aa, IL 815 ILCS 530/, and HIPAA Breach Notification Rule 45 C.F.R. § 164.404 where applicable), intentional violations (suspension or termination). Assign AI policy ownership to a named role or committee.

Set the quarterly review and update cadence

AI technology and regulation move faster than any other policy area. Commit to quarterly review with interim updates triggered by new AI regulation (federal, state, local), changes to approved AI tools or vendor terms of service (consumer ChatGPT terms changed three times in 2023 alone), material AI-related incidents (data exposure, hallucination-caused errors, bias complaints, regulatory inquiries), and introduction of new AI tools into the technology stack.
